Brand New Defective Sprint Tablet from a 3rd Party Retailer. Sprint store won't help. Am I out of luck?

I recently bought an HTC Evo View 4G from an online ebay store for an awesome price of $240, out of contract. I had read that Sprint was offering prepaid data plans with the tablet, and I thought this would be a great entry tablet for me and I could use the 4G when I travel since I don't have 4G in my hometown.

Anyway, when I received the tablet, the back cover had an obvious issue and would not stay securely connected to the device. I contacted the seller, but they had sold out and could only offer me a refund instead of a replacement. The seller suggested I go to a Sprint store and ask them to swap out the defective unit since it's under manufacturer warranty. When I walked into a Sprint store they basically told me there was absolutely nothing they could do for me and I'd have to exchange it through the original seller.

The original seller also suggested the next step I could take is to contact HTC and request a defective unit replacement through them. When I contacted HTC they let me know I would pay for shipping charges and the best they could do is REPAIR the defective unit. I told them I wasn't interested because I paid for a brand new unit and I would like to have a brand new unit.

I'm about to send the tablet back to the original seller for a full refund, but I'd really like the tablet and would like to use it on Sprint's service. I really don't understand why the Sprint store can't take back the phone and swap it out since they could just get credit back for the defective unit and keep me as a customer. I used to sell Sprint phones about 5 years ago and I remember the process to be extremely easy as long as it was actually a manufacturer defect and I was always happy to help out people who ended up with lemons. IIRC we used to get the full value back from defective units--meaning it would have cost the Sprint store anything. I can't imagine the process has changed so dramatically they can no longer do this for customers...

My question is: Do I have any other options? I love the tablet and I want to keep it, but this back cover near the USB port is lose and exposes the circuits. I'd like to find a way swap this out so I can actually have a new working tablet at the amazing price I purchased it at. So far my only options are to get a refund and try to find a great price on the tablet again, or get a repair--and a repair is just out of the question because of the cost and the potential issues I will have down the road. Any advice is greatly appreciated

Thanks,

nvvman

Why should Sprint replace a damaged unit that you bought on Ebay, Return it to the seller. There is a reason you got it so cheap.

Because the tablet is a brand new Sprint device and it's defective. The end result is that they won't have my service and I was only looking for an alternative option. Also, the reason I got it for so cheap has nothing to do with the fact that is defective, nor does it imply that the ebay store is selling less than new items. The ebay store I purchased it from sold thousands of these tablets and I just got unlucky.

Sprint will swap out a device purchased from Sprint for the first 14 days.  After that it is manufactures warranty.   We do not do any work on tablets at all.  With phones it is a little different but still for the first 14 day all exchanges have to be done with the orginal point of sale.  If the device has TEP on it will will attempt repair  or replacement.  We do not offer TEP on tablets.  The original seller is trying to preserve his profit and wants either sprint or HTC to replace the device.

Actually the original seller offered a full refund, so I believe he is not trying to preserve his profit. I find it bizzare that Sprint will not help me out in anyway considering that this is an issue with a brand new defective unit. I'm fairly sure that my only option is to get a full refund and then just buy another tablet on sale, but I started this thread to ask if anyone is aware of any alternative options.

Even if it was purchase from a Sprint authorized reseller, Best Buy, Radio Shack, Amazon, Wirefly, Etc... You'd still have to go to the point of purchase to get it replaced, Sprint will not replace it when they did not sell it to you.

I understand that Sprint will not take it back, even though I've expressed my disdain and disagreement. I even stated this in my original post. I'm simply asking for any alternative options. I appreciate that you are trying to provide information, but this is starting to get off topic.

Do I have any alternative options for my particular dilemma?

Can you post a pic of what it looks like, When I picked mine up the store actually damaged one trying to remove that bottom piece looking for where to place the SD Card. It shouldn't effect functionality where you should be able to super glue the piece if the tabs to lock it in place were broke off like they did the one they were "practicing" on when I got mine.

That sounds like a very similar issue. The bottom plastic part was loose when I received the device, and popping up just far enough from the rest of the tablet to slightly cover the usb port. When I tried to push it back into place, thinking that it would just snap in, a small connector from the circuit board that was also loose fell out. I thought about just keeping the tablet because if I fit it into my case, the plastic piece is held firmly in place, but I'm afraid of what else could be wrong with the tablet. I believe the piece that fell out is part of the antenna contact.

Unfortunately, I cannot post a picture at the moment since I'm at work.

If you're afraid of what else could be wrong with it, I would just send it back to EBay, get a refund, and look around for another one.  Who knows - you found a deal once, it's liable to happen again.
